LAND CONVEYANCE THE LEGALITY OF TRANFER

•Any conveyance of land in order to be legal it has to be in accordance with the Land Act.

•For the purpose of this, the reference should be made in section 61 of Land Act.

•Any attempt to dispose of any right of occupancy other than what stipulated under Land Act shall be ineffectual.

•See section 61 LA.

PARTIES TO CONVEYANCING

1.Transferee

•This is the person who receives the right of occupancy, lease or mortgage passed by an act of transfer.

2. Transferor

This is the person who passes the right of occupancy, a lease or mortgage by an act of transfer.

DISPOSITION INSTRUMENTS

•The prescribed forms are schedules to the Land (Forms) Regulations, 2001.

•These forms for sale or transfer of land are the following:

FORM NO 29, 30 and 33

FORM NO 35 –for the transfer of Right of Occupancy,

FORM NO 38- for the contract for the transfer of right of occupancy
